IoT Card Recharge Platform Service Agreement

【First Part and Introduction】

Welcome to use the IoT card recharge platform service!

The "IoT Card Recharge Platform Service Agreement" (hereinafter referred to as the "Agreement") is jointly concluded by you and LNA IOT, and this agreement has contractual effect. In order to use the services of the IoT card recharge platform, you should read and abide by this agreement. Please read carefully and fully understand the contents of the terms, especially the terms that exempt or reduce our liability, the terms of jurisdiction and applicable laws, and the separate agreement to activate or use a certain service. Restrictions and exemptions may be bolded in bold to remind you to pay attention.

Unless you have read and accepted all the terms of this agreement, you have no right to use the services provided by LNA IOT. Your use of LNA IOT's services is deemed to have read and agreed to the constraints of the above agreement.

If you are under the age of 18, please read this agreement with your legal guardian and pay special attention to the terms of use for minors.

1. [Scope of Agreement]

1.1 This agreement is an agreement between you and LNA IOT regarding the user's use of the IoT card recharge platform service. "LNA IOT" refers to the possible operating affiliates of the LAINA INTELLIGENT(HK) LIMITED CO., Ltd and its related services. "User" refers to the user who uses LNA IOT related services, and is more referred to as "you" in this agreement.

1.2 The service under this agreement refers to the IoT card recharge platform service, specifically refers to the technical service platform provided by LNA IOT to users through the Internet (including mobile Internet). The user uses the technical service platform provided by LNA IOT to provide services to third parties or their agents. Recharge designated products or businesses by yourself or others (hereinafter referred to as "the service"). You know that the services under this agreement are only a technical service platform for LNA IOT to provide you with recharge services. LNA IOT is not a service provider or agent that provides you with recharge services, nor is it your agent, partner, employee or employer and other business related parties. The entities that provide recharge on the IoT card recharge platform are all third parties, not LNA IOT (unless LNA IOT has other special and explicit instructions for recharge provided by LNA IOT). You and the main body that provides the recharge service for recharge cooperation, LNA IOT does not participate in the specific recharge cooperation between you and the third party. The payment services involved in your use of the aforementioned services are provided by Third-party Payment Service Provider‌, and you should also abide by the relevant provisions of Third-party Payment Service Provider. The specific agreement between you and Third-party Payment Service Provider shall prevail. This service may include multiple brands, depending on the specific service content provided by LNA IOT to users on each platform.

2. [Mailbox]

2.1 When you use LNA IOT's services, you need to provide an email address, and LNA IOT will send some information to your email address. You fully understand and agree to this.

3. [Protection of User Personal Information]

3.1 Protecting users' personal information is a basic principle of LNA IOT.

3.2 In the process of registering an account or using this service, you may need to fill in some necessary information. For example, you need to fill in your phone number in order to use the phone recharge service. If there are special regulations in national laws and regulations, you need to fill in the true identity information. If the information you fill in is incomplete, you will not be able to use this service or will be restricted during use.

3.3 Generally, you can browse and modify the information submitted by yourself at any time, but for security and identification (such as number appeal service) considerations, you may not be able to modify the initial registration information and other verification information provided during registration.

3.4 LNA IOT will use various security technologies and procedures to establish a complete management system to protect your personal information from unauthorized access, use or disclosure.

3.5 LNA IOT will not transfer or disclose your personal information to any unrelated third party, unless:

(1) Relevant laws and regulations or requirements of courts and government agencies;

(2) Transfer to complete merger, division, acquisition or asset transfer;

(3) To perform the purpose of this agreement;

(4) Necessary to provide the service you request;

(5) You authorize and agree to disclose;

(6) You take the initiative to share with a third party;

(7) As otherwise provided by laws and regulations.

3.6 LNA IOT attaches great importance to the protection of the personal information of minors. If you are a minor under the age of 18, you should obtain the written consent of your parent or legal guardian (hereinafter referred to as the "guardian") before using the services of LNA IOT.

4. [Method and scope of using this service]

4.1 Unless you and LNA IOT agree otherwise, you agree that this service is only for your personal non-commercial use.

4.2 You may need to download client software to use this service, or you may need to log in to the website or platform operated by LNA IOT and other platforms and channels authorized by LNA IOT. For the use of client software, LNA IOT gives you a personal, non-transferable and non-exclusive license. You can only use these software and services for the purpose of accessing or using this service.

4.3 The client software in this service provides multiple application versions including but not limited to IOS, android, etc. The user must select the software version that matches the installed mobile phone.

4.4 You should use this service through a method provided or approved by LNA IOT. The rights you obtain under the terms of this agreement are not transferable.

4.5 You must not use plug-ins, plug-ins or third-party tools that are not authorized by LNA IOT to interfere, destroy, modify, or exert other influences on the services under this agreement.

4.6 Scope of this service license

4.6.1 LNA IOT grants you a personal, non-transferable and non-exclusive license to use this service. You can install, use, display, and run the software on a single terminal device for non-commercial purposes.

4.6.2 You can make a copy of the software for the purpose of using the software and services, only as a backup. The backup copy must contain all copyright information contained in the original software.

4.6.3 All other rights not expressly authorized by this article and other terms of this agreement are still reserved by LNA IOT, and you must obtain additional written permission from LNA IOT when exercising these rights. If LNA IOT fails to exercise any of the aforementioned rights, it does not constitute a waiver of that right.

5. [Notes for users]

5.1 You understand and agree: some functions of this service may let a third party know your information, for example: you use this service to recharge the ICCID number submitted by a third party, and the third party can know the ICCID number submitted by the user and other information.

5.2 When you use this service, there may be separate agreements, relevant business rules, etc. (hereinafter collectively referred to as "separate agreements"). Please read and agree to the relevant separate agreements before using this service.

5.3 You understand and agree that LNA IOT will use its commercially reasonable efforts to ensure the security of your data storage in the software and services. However, LNA IOT cannot provide a complete guarantee for this, including but not limited to the following situations:

5.3.1 LNA IOT is not responsible for the failure to delete or store your relevant data in the software and services;

5.3.2 LNA IOT has the right to determine the maximum storage period of a single user's data in the software and services according to the actual situation, and allocate the maximum storage space for the data on the server. You can back up the relevant data in the software and services according to your own needs;

5.3.3 If you stop using the software and service or the service is terminated or cancelled, LNA IOT can permanently delete your data from the server. After the service is stopped, terminated or cancelled, LNA IOT has no obligation to return any data to you.

5.4 When using the software and services, users must bear the following risks that are beyond the control of LNA IOT, including but not limited to:

5.4.1 The risks of personal information loss and leakage that may be caused by irresistible factors;

5.4.2 If you need to download software, the user must select the software version that matches the installed mobile phone, otherwise, any problems or damage caused by the mismatch between the software and the mobile phone model will be borne by the user;

5.4.3 When the user uses this service to visit a third-party website, the risks that may be caused by the third-party website and related content shall be borne by the user;

5.4.4 The content posted by users is forwarded and shared by others, so the risks and responsibilities that may be caused by such dissemination;

5.4.5 Risks such as user login failure, incomplete data synchronization, and slow page opening speed caused by unstable wireless network signals and low wireless network bandwidth.

5.4.6 The user has the legal rights and interests of the products or services he has recharged, and guarantees that it will not infringe the legal rights of any third party, and that it will not violate the relevant national laws and regulations. For example, you are the legal user of the mobile phone number you top up or have obtained the authorization of the legal user.

5.5 Third-party products and services

5.5.1 When you use products or services provided by a third party of this service, in addition to complying with the provisions of this agreement, you should also comply with the third party's user agreement. LNA IOT and the third party shall each be responsible for possible disputes within the scope of legal provisions and agreements.

5.5.2 When the user uses the service or requires LNA IOT to provide specific services, the service will call a third-party system or support the user's use or access through a third party. The result of the use or access is provided by the third party, and LNA IOT does not guarantee The security, accuracy, validity, and other uncertain risks of the services and content provided by the three parties. Any disputes and damages caused by this have nothing to do with LNA IOT, and LNA IOT shall not bear any responsibility.

6. [Provide services according to the status quo]

You understand and agree that LNA IOT's services are provided in accordance with the status quo that can be achieved with existing technology and conditions. LNA IOT will do its best to provide services to you to ensure the continuity and security of the service; however, LNA IOT cannot foresee and prevent legal, technical and other risks at any time, including but not limited to force majeure, viruses, Trojan horses, hacker attacks, system instability, Service interruption, data loss and other losses and risks that may be caused by third-party service defects, government actions and other reasons.

7. [Bring your own equipment]

7.1 You should understand that you need to prepare the terminal equipment (such as computers, modems, etc.) and bandwidth and other resources related to the relevant services by yourself to use LNA IOT's services, and bear the required expenses (such as telephone charges, Internet charges, etc.), You need to obtain relevant tariff information from the operator yourself and bear the relevant expenses yourself.

7.2 You understand and agree that when you use this service, your terminal equipment, bandwidth and other resources will be consumed.

8. [Advertising]

8.1 You agree that LNA IOT may send you advertising, promotional or promotional information (including commercial and non-commercial information) by itself or by a third-party advertiser in the process of providing services, and the method and scope of this information may be changed without special notice to you.

8.2 LNA IOT may provide you with the option to turn off advertising information, but at any time you will not be able to block or filter advertising information in a way that is not expressly agreed in this agreement or LNA IOT does not have written permission.

8.3 LNA IOT fulfills relevant obligations to advertisers in accordance with the provisions of the law. You shall judge the authenticity of the advertising information by yourself and be responsible for your own judgment. Except as expressly provided by the law, you are responsible for the transaction based on the advertising information or the aforementioned advertisers’ provision LNA IOT shall not be liable for any loss or damage suffered due to the content of the content.

8.4 You agree that you should prudently judge the authenticity and reliability of the advertising information appearing in the LNA IOT service, and unless expressly provided by law, you are responsible for the transactions carried out based on the advertising information.

9. [Charging Service]

9.1 Part of LNA IOT's services are provided on a fee basis. If you use fee-based services, please abide by the relevant agreements.

9.2 LNA IOT may modify and change the charging standards and methods of charged services according to actual needs, and LNA IOT may also start charging for some free services. Before the aforementioned amendments, changes, or charging starts, LNA IOT will notify or announce on the corresponding service page. If you do not agree to the above modification, change or paid content, you should stop using the service.

10. [Products or services provided by third parties]

10.1 When you use products or services provided by a third party on the LNA IOT platform, in addition to complying with the provisions of this agreement, you should also comply with the third party's user agreement.

10.2 As mentioned earlier, LNA IOT only provides you with a technical service platform for the recharge business. LNA IOT is not a service provider or agent that provides you with recharge services, nor is it your agent, partner, employee, or employer or other business relationship. The entities that provide recharge on the IoT card recharge platform are all third parties, not LNA IOT (unless LNA IOT has other special and explicit instructions for recharge provided by LNA IOT). You and the third-party entity that provides the recharge service are involved in recharging cooperation, and LNA IOT does not participate in the specific recharging cooperation between you and the third party. The third party shall provide you with an invoice for the recharge service you enjoy on the IoT card recharge platform. You understand and understand that LNA IOT is not the subject of providing you with an invoice, and you will not ask for an invoice from LNA IOT. However, LNA IOT will try to assist you in obtaining invoices from third parties.

10.3 The product or service strategy and specific content provided by the third party are determined by the third party, and LNA IOT does not participate in it. For example, some third parties provide products or services by region, and different regions will have different product or service strategies. We cannot guarantee that you will be able to enjoy the products or services provided by the third party; if you cannot enjoy the products or services provided by the third party for products or services, please consult the third party for specific information. LNA IOT does not assume any responsibility for this. For example, data recharge may not be able to provide you with recharge services due to operator policy restrictions in some regions, and may not be able to recharge or recharge fails and refunds.

10.4 You are aware of and agree that the third party will provide you with corresponding customer service for the third-party services that you accept through the use of this service. LNA IOT will only provide you with necessary support and assistance within a reasonable range. Any disputes or disputes caused by the user's use of third-party services shall be resolved by the third party, and LNA IOT shall not bear any responsibility. LNA IOT does not provide customer service support for third-party services. If you need support, please contact the third party.
